Carrier Regulatory Requirements for 10DLC Approval & Filter Remediations
Mobile carriers require a privacy policy posted to your brand website in order to transact messaging across 10DLC, Short Code, or Verified Toll-Free number channels. Even if you’ve never had one before, you must comply with these regulatory requirements.
The carrier's stated goal is to protect their subscribers from sharing or selling their customers' mobile consent. Posting a compliant policy serves two purposes:
- When the carrier or third-party auditors review a trusted sender campaign over the three sending channels, they will read your privacy policy.
- When remediating any carrier filtering, a compliant privacy policy results in quicker resolution times.
Compliant Privacy Policy
Most policies will have a “Data we Collect” and “Information we Share” section. If you share or sell data to 3rd parties for commercial purposes, you can add a simple disclaimer to mobile consent data. We recommend calling it out with an asterisk and bold font for potential human auditors. The language below is sufficient (and, of course, you must comply with this language):
All the above excludes text messaging originator consent and opt-in data; this information will not be shared with any third parties.
Making your Policy Accessible
Your Privacy Policy should be easy to find and accessible on your web page’s header or footer.
Don't have a Privacy Policy?
- If your brand website does not have a privacy policy posted, we highly recommend that you engage legal counsel to draft and post one. For companies that do not have legal counsel available for this, you may investigate privacy policy builder products such as https://termly.io/.
- Additionally, some states, such as California, have their own specific laws regarding how data is collected from web visitors and how those visitors are notified of this practice. These specific nuances are why Sense recommends engaging legal counsel or using a product such as termly.io.
- You can also find a sample boilerplate web privacy policy here. Please be advised that whatever privacy policy you post to your brand website, your company is responsible for it and must adhere to it.
